The purchase of products in E-Commerce at the Pos Direct Online Store is subject to the following terms and conditions:

 

Object

1.1 These current General Conditions, together with the order form and other elements referred to therein, regulate the terms and conditions under which the provision of the Service at the Pos Direct Online Store will be governed.

1.2 The purchase of any product at the Pos Direct Online Store implies acceptance of these General Conditions of Online Sale.

1.3 Access to the Pos Direct Online Store is free of charge and does not require prior subscription or user registration.

1.4 Alcoholic beverages available for sale at the Pos Direct Online Store can only be purchased by individuals of legal age to do so in their country of residence.

 

Product Information, Prices, and Contents

2.1 Pos Direct reserves the right to modify, without prior notice and at any time, the information and commercial offer presented on: products, prices, promotions, commercial conditions, and services.

2.2 Images illustrating each product at Pos Direct may differ from the product subsequently delivered.

2.3 Items for sale in the online store are subject to available stock, and orders will be processed on a first-come, first-served basis. In case of temporary or definitive out-of-stock situations, the customer will be duly notified, and an alternative with similar characteristics will be suggested.

2.4 Under Portuguese law, product prices are indicated in € (euros) and include VAT at the current legal rate, as well as packaging costs. The cost of shipping to the customer is not included.

2.5 Promotions carried out in the online store are not applicable in the physical store of Pos Direct.

 

Ordering and Payment

3.1 To make a purchase at the Pos Direct Online Store, the user must register as a customer.

Once registered, the user can place their order by selecting the desired products. They must follow all the steps described therein to successfully complete the order.

3.2 After confirming the order at the Pos Direct online store, the customer must select the preferred payment method from the available options, including Multibanco, MB WAY, Visa, Mastercard.

Any order placed at the Pos Direct online store will only be processed after the effective receipt of payment. The formalization of the order itself does not constitute a reservation of the products.

3.3 After confirming the order at the Pos Direct online store, an email will be sent to the contact address registered by the customer at the time of formalization, containing all the details regarding delivery, invoicing, and payment information. If the customer does not receive the order confirmation email, they are requested to contact Pos Direct via telephone at 289 586 137 or via email at info@posdirect.store.

3.4 Changes to the conditions of orders not yet dispatched or the cancellation of an order not yet dispatched can be made upon request via email to info@posdirect.store.

3.5 Orders placed by users from countries outside the European Union must be validated in advance.

3.6 Orders will only be shipped after stock confirmation and payment, and will be processed on a first-come, first-served basis.

3.7 If an order cannot be fulfilled in part or in full, the customer will be immediately contacted by Pos Direct.

3.8 Delivery expected within 1 business day. Orders placed by 4:00 PM on a business day are typically delivered on the following business day.

3.9 The Pos Direct Online Store offers the following payment methods to the user: bank transfer, debit/credit card, and MBway.

3.10 Proof of bank transfer must be sent to the email info@posdirect.store.

3.11 Payments are received in euros, regardless of the currency used for the transaction. Conversion fees for payments made in other currencies must be borne by the customer.

 

Shipping Costs

4.1 The shipping cost is calculated based on the weight of the products, destination, and total value of the order.

4.2 The shipping cost is indicated in the shopping cart before final validation of the order, for deliveries to mainland Portugal. For deliveries outside mainland Portugal, the total shipping cost is calculated after confirmation of the customer's order via email to info@posdirect.store.

 

Delivery

5.1 Orders will only be shipped after confirmation of stock and payment, and as quickly as possible.

5.2 Delivery of orders will be made to the address indicated by the customer and according to the delivery schedules of the transport company. Delivery to post office boxes is not possible. Deliveries of orders outside mainland Portugal can be made if the address is covered by the transporter's delivery area.

5.3 As the transport service is contracted to a company, any possible delays in deliveries cannot be resolved by Pos Direct, and therefore exact delivery times cannot be guaranteed in such cases.

5.4 If for any reason the customer cannot receive the order or collect it at the location indicated by the transporter, the customer is requested to immediately contact the Pos Direct Online Store via email at info@posdirect.store.

5.5 All products shipped by Pos Direct must be checked upon delivery. If the customer finds that the order is damaged, they should return it immediately to the transport company, indicate the reason for the return on the shipping label, and promptly inform the Pos Direct Online Store via email at info@posdirect.store.

5.6 If after delivery, the customer finds that any of the items are not in accordance with their order, they are requested to immediately contact Pos Direct via email at info@posdirect.store, providing the order number or the document number accompanying the order, and attaching images of the packaging as received and of all items, so that the situation can be resolved as quickly as possible.

 

Returns/Complaints

6.1 The Pos Direct Online Store allows returns of products within a period of 14 days.

6.2 To request an exchange or return, the customer is asked to contact Pos Direct via email at info@posdirect.store indicating the invoice number.

6.3. The return of defective products and incorrect shipments is the responsibility of Pos Direct, as well as the shipping and collection costs when the customer reports this situation within 14 (fourteen) days from the date of receiving the product. Once the goods are received at our premises and after validation of their condition in accordance, the refund will be made by bank transfer.

6.4 Pos Direct is not responsible for deficiencies resulting from incorrect use, negligence, and poor storage conditions by the customer.

 

Change of General Conditions

These general conditions of online sale may be changed without prior notice, and therefore should be consulted before placing any order.

 

Data Protection

 

The Client must expressly declare their authorization for the collection or updating of their contact data, for integration into Pos Direct's files for the purpose of customer management, commercial relations, as well as for sending advertising about products and services in accordance with Law No. 6/99, Law No. 41/2004, and Directive No. 2002/58/EC, through automated processing and profiling, through all available communication channels, including electronic means.

 

Express consent must be given when registering on the Online Store, in the option indicated for that purpose.

 

The contact data collected will be kept for the period during which the purpose for which their processing was consented persists, or until the exercise of the right to oppose, rectify, and delete them.

 

The data subject has the right to access their stored data free of charge, as well as to request their limitation, rectification, opposition, or deletion when, among other legal grounds, the contact data are inaccurate or are no longer necessary for the purpose for which they were collected.

 

The data subject also has the right to withdraw their consent at any time, without compromising the legality of the processing carried out based on the previously given consent.

 

If technically feasible, they may request the portability of their data to another data controller, in which case the data will only be retained for the purpose of making, exercising, or defending legal claims.

 

When exercising any of the aforementioned rights, we reserve the right to keep the data exclusively for the purposes of making, exercising, or defending a right in a judicial proceeding.

Pos Direct does not transfer the contact data collected to third parties. If there is a legitimate reason for their transfer, the Client will be informed in advance, and the recipients' identity and the purpose of the data processing will be communicated.

 

The transfer will only occur when the third parties provide sufficient guarantees for the implementation of appropriate technical and organizational measures, so that the processing meets the requirements and obligations arising from the applicable data protection legislation and ensures the defense of the data subject's rights.

 

Declaration of Responsibility

Pos Direct expressly declares and guarantees that:

a) It will adequately treat the Personal Data it collects from its Clients in the context of providing the Online Store Service, ensuring that they are lawfully and confidentially processed, fairly and transparently, and in a manner that ensures their security, notably by undertaking to protect this Personal Data against accidental or unlawful destruction, accidental loss, alteration, dissemination, or unauthorized access;

b) It is in a position to ensure all appropriate technical and organizational measures so that the processing of Personal Data meets the requirements of the current Personal Data Protection Law, approved by Law No. 67/98, of October 26, and by Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, ("GDPR"), which will come into force on May 25, 2018;

c) Personal Data is only intended for the execution of orders placed in the online store, and only the necessary, adequate, relevant, and limited data are collected for this purpose;

d) It will keep Personal Data accurate and up-to-date;

e) It will not use the Personal Data to which it has access for any purpose other than that provided for in these Terms and Conditions;

f) At the customer's request, it will immediately and efficiently destroy the said Personal Data.
